Decision of the Election Decision Officer on Nomination Forms in Zilla Parishad and Panchayat Samiti Elections to Be Final
Ordinance to Amend the Election Act, 1961
The Cabinet meeting, chaired by Chief Minister Devendra Fadnavis, approved an amendment to Section 14(2) of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961.
This decision is important to ensure that elections to Zilla Parishads and Panchayat Samitis in the state are conducted on time and in a time-bound manner. Under sub-section (2) of Section 14 of the Act, an appeal could earlier be filed before the District Court against the decision of the Election Officer accepting or rejecting a nomination form. However, as a large number of such appeals remained pending in various District Courts for different durations, it became difficult to conduct elections within the prescribed timeframe.
In view of this, the State Election Commission had submitted a proposal to the government to delete this provision. Accordingly, provisions have now been included empowering the State Government to frame rules regarding such elections, and stipulating that the decision of the Election Decision Officer regarding acceptance or rejection of nomination forms shall be final.
The Cabinet has therefore approved the promulgation of the Maharashtra Zilla Parishads and Panchayat Samitis (Amendment) Ordinance, 2025.
